My mother’s car was towed away because my loser brother had it and got arrested. She did not have enough money to get it out of the towing company. The company said they will be selling the car. She still owes money to the finance company. How can they sell a car without the title?

they send a notice of lien and intent to sell to you and the bank. Depending on the state, you and the finance company will have a specific period of time to pay the tow and storage fees and get the car back. If you do not, the tow company will sell the car on lien papers. the state will issue a clear title to the new owner, since both you and the bank waived your rights to the car. The bank will then sue you for the balance remaining on the contract.

    Your mother owe towing charge so they can put a lien on the property. After filing the forms with the DMV and the DMV checks things out, the DMV can issue the title to the tow company.

    It’s like if you own a house and not pay the property tax. The county can takeover and kick you out of your house because you owe money to them.
